As you look at the matter of civil rights and the Constitution, it is worth taking some time to explore areas that we consider to be fundamental rights. Some of these are pretty easy: voting, speech, religion. Other rights are considered to be fundamental, but are subject to considerable debate. For example, the right to marry is considered a fundamental right, but should it extend to same-sex couples? This was the legal question at the heart of the Supreme Court case of Obergefell v. Hodges (2015). Remember that the Court ruled in this case that states must allow same-sex couples to marry. It was a 5-4 decision.

However, this is not the first time that the Court has tackled the topic of marriage and its shifting parameters.

To highlight this debate, let’s consider a couple of decisions and opinions from the Supreme Court.

Loving v. Virginia (1967)

Mildred and Richard Loving, an inter-racial married couple, were arrested and convicted of violating Virginia’s anti-miscegenation law (bans inter-racial marriage). Forced to move from the state or face incarceration, they challenged the constitutionality of the law as it violated the 14th Amendment.

Writing for a unanimous Supreme Court, Chief Justice Warren struck down Virginia’s law and concluded that, “Marriage is one of the “basic civil rights of man,” fundamental to our very existence and survival…. To deny this fundamental freedom on so unsupportable a basis as the racial classifications embodied in these statutes, classifications so directly subversive of the principle of equality at the heart of the Fourteenth Amendment, is surely to deprive all the State’s citizens of liberty without due process of law. The Fourteenth Amendment requires that the freedom of choice to marry not be restricted by invidious racial discrimination. Under our Constitution, the freedom to marry, or not marry, a person of another race resides with the individual and cannot be infringed by the State.”

This opinion would become part of the Court opinion in the following case.

This particular case is really a collection of six different legal challenges coming out of states in the 6th Federal Circuit (Michigan, Kentucky, Tennessee and Ohio). While the circumstances of the plaintiffs varied in each of the six cases, at the core was the challenge brought to state laws banning same-sex marriage.

Writing for the majority of the Court, Justice Kennedy stated, “Marriage is sacred to those who live by their religions and offers unique fulfillment to those who find meaning in the secular realm. Its dynamic allows two people to find a life that could not be found alone, for a marriage becomes greater than just the two persons. Rising from the most basic human needs, marriage is essential to our most profound hopes and aspirations.”

However, this opinion was not shared by all members of the Court. Indeed, Chief Justice Roberts wrote, “Many people will rejoice at this decision, and I begrudge none their celebration. But for those who believe in a government of laws, not of men, the majority’s approach is deeply disheartening. … Five lawyers have closed the debate and enacted their own vision of marriage as a matter of constitutional law. Stealing this issue from the people will for many cast a cloud over same-sex marriage, making a dramatic social change that much more difficult to accept.”

Later in the same opinion he states: “If you are among the many Americans – of whatever sexual orientation – who favor expanding same-sex marriage, by all means celebrate today’s decision. Celebrate the achievement of a desired goal. Celebrate the opportunity for a new expression of commitment to a partner. Celebrate the availability of new benefits. But do not celebrate the Constitution. It had nothing to do with it.”

Finally, although the Court has issued the decision, the implementation of the law was not without challengers. Most notably, Kim Davis (a clerk in Kentucky) created quite a media spectacle by refusing to issue marriage licenses citing her religious objections to same-sex marriage. Based on the information provided in the scenario, this patient may be suffering from acute appendicitis. However, much more information is needed to confirm this diagnosis. Time of onset of symptoms would need to be known, in addition to which PRN medications she has taken for her symptoms. A list of current medications is needed. A more thorough exam is needed, including a thorough gastrointestinal examination checking for rebound tenderness and bowel patterns. Appendicitis is the third most common indication for abdominal surgery in the elderly patient. Patients with appendicitis typically present with right lower quadrant pain, fever, anorexia, or leukocytosis. The use of CT scan is necessary to make this diagnosis in a timely fashion. A differential diagnosis for this patient may be diverticulitis, in which the patient typically presents with fever, nausea, change in bowel regimen, and LLQ pain. However, patients may present with RLQ pain if the right colon is predominantly involved. CT scan is recommended to diagnose this problem, as it is highly sensitive and specific for this disease (Spangler et al., 2014). Another potential diagnosis may be peritonitis, which can be caused by a perforated ulcer, appendix, or diverticulum. Patients with peritonitis often present with severe abdominal pain, rigid abdomen, rebound tenderness, absent bowel sounds, hypovolemic shock, fever, vomiting, tachycardia, and tachypnea. She may also be experiencing inflammatory bowel disease, including ulcerative colitis and Chron’s disease. Signs and symptoms include abdominal pain, lethargy, nausea, vomiting, fever, tachycardia, diarrhea, and signs of shock (“Chapter 10: Gastrointestinal emergencies,” 2016). For a patient presenting with abdominal pain, common blood tests needed include CBC, CMP (to assess electrolytes and kidney function), Liver panel, CRP and CK to determine inflammation. A lactate level may be used for evaluation of overall status and intestinal ischemia. Blood cultures would be needed as well to look for bacteremia. A urinalysis should also be obtained to rule out urinary tract infection, which may also be another potential diagnosis for this patient (Mayumi et al., 2016).

Appendicitis is the inflammation of the appendix, which can cause the patient to had abdominal pain with the most disteing paing being in the right lower quadrant (Appendicitis – Symptoms and causes, 2018). The patient can present with nausea, vomiting and fever. The diagnostic test that would help diagnose would be CBC with differential, and CT scan to see if appendix is inflamed. The treatment can be antibiotics and appendectomy, to prevent the rupture of the appendix and cause the sepsis. The differential diagnosis can be peritonitis which happens in elderly the perforation of the GI tract (Dains, Baumann, & Scheibel, 2012)

Abdominal pain complaints in the Emergency department are common and comprise about 11% of the total visits (Gross, 2018). The patient’s perception and description of the pain are vital, OLD CHART is a great subjective tool to obtain all the information regarding the pain. The history and physical should yield the diagnosis some 90-95% of the time (Gross, 2018). Additional testing whether lab work, CT, or X-Ray should only be used to confirm the presumptive diagnosis, according to Gross (2018) “it is rare that “fishing” with laboratory tests will yield a diagnosis when the

H&P does not, and this practice should be condemned” (para 3).

Abdominal Pain during Pregnancy

Nausea, vomiting, and abdominal pain are very common in pregnancy, according to McCarthy, Lutomski, Greene (2014) up to 80% of pregnant women experience nausea and vomiting, most commonly in the first trimester. Furthermore, signs and symptoms that may indicate additional concerns would include nausea and vomiting persisting past mid-pregnancy (approximately 20 weeks) and associated abdominal pain, fever, or diarrhea (McCarthy, Lutomski, Greene, 2014). However, due to the physical changes that occur to the women during pregnancy such as, the enlarging uterus and fetal position/movement, abdominal pain is also common in pregnancy (McCarthy, Lutomski, Greene, 2014). Additionally, an investigation into nonpregnancy-related causes is warranted when there is pain that is localized, abrupt, constant, or severe or pain that is associated with nausea and vomiting, vaginal bleeding, or fever (McCarthy, Lutomski, Greene, 2014). A consult with an obstetric specialist is then recommended as soon as possible. In conclusion, appendicitis remains the most common cause of acute abdomen in pregnancy, and a delay in diagnosis increases fetal mortality (McCarthy, Lutomski, Greene, 2014).

Abdominal Pain in Pediatrics

Acute problems like appendicitis are rarely the cause. Many children are healthy and growing with no abnormalities on physical examination or laboratory work-up (D’Alessandro, 2018). According to D’Alessandro (2018) “laboratory and/or radiological evaluations should be guided by the history and physical examination and should be used, especially if there is evidence of infection, inflammation, or anatomic abnormality suspected” (para 4). Routine laboratory testing would include CBC, sedimentation rate, liver function test, and a urinalysis should be completed first and then possibly radiographic evaluation may be indicated and usually starts with a plain abdominal radiograph but may also include fluoroscopy, ultrasound, or CT scan (D’Alessandro, 2018). Acute problems like appendicitis are rarely the cause (D’Alessandro, 2018).
